Booking Conditions
Contract of Hire
The Hiring contract will be between the hirer and the owner of the property for which the booking is made and will be deemed to be made subject to these conditions of hire. The Contract of Hire will not be effective until the owner dispatches to the hirer written confirmation of a booking.
Payment
Bookings will be confirmed by the owner on receipt of the appropriate initial payment as detailed on the booking form. At this time a booking confirmation/state of account will be issued, showing the cost of accommodation rental and breakage deposit less the initial payment made. The outstanding balance payable to the owner will be due not less than eight weeks before arrival.
Breakage Deposit
A refundable breakage deposit of 100 pounds per holiday will be included in the booking confirmation and is payable not less than eight weeks before departure. The breakage deposit will normally be refunded to the hirer within four weeks after the end of the holiday. If there are any breakages, gas cylinders to be replaced, heating or electricity owing, or more than reasonable cleaning required, then the owner reserves the right to deduct these costs from the deposit. Additionally, if there are any charges in excess of the breakage deposit, then the hirer will reimburse the owner accordingly.
Cancellation of Booking
Provided that written confirmation is received not less than eight weeks before the holiday commencement date, hirers will not be held liable to pay the balance of the accommodation rental. Furthermore, if the owner is successful in re-letting the holiday, then the deposit will be refunded less an administrative charge of 30pounds. These conditions apply to cancellations within eight weeks of the holiday commencement date so long as the owner has been successful in re-letting the holiday. For holidays not re-let, hirers will automatically lose their deposit and will also be liable to pay the remaining balance of the accommodation rental. In other respects the owner will hold the hirer responsible only to the extent that he incurs a financial liability.
Alterations to Booking
The owner will endeavour to act upon a hirer’s requests for subsequent changes to a booking, but reserves the right to charge an administration fee of 15 pounds per alteration and to charge the hirer for any other costs incurred.
Gas and Electricity Charges
All gas and electricity used for domestic consumption (excluding heating) is included in the cost of the holiday.
Payment for Space Heating
The cost of electricity, gas or wood for space heating is due and payable to the owner before the hirer’s departure.
Amenities
The use of accommodation and amenities such as play areas, bicycles and swimming pools is entirely at the users’ risk and no responsibility can be accepted for injury and loss or damage to users’ or visitors’ belongings.
Personal Belongings
Baggage and personal belongings are at the hirers’ risk at all times
Motor Car
No responsibility can be accepted for the loss or damage to any car or its contents.
Hirer’s Responsibility
The hirer is responsible under French Law for the property and its contents whilst on holiday. It is strongly recommended that the hirer take out Personal Travel and Cancellation Insurance. The hirer is also responsible for leaving the property in a clean and tidy condition.
Party Size
In no circumstances may more than the maximum number of people stated in the details be exceeded, except by prior agreement with the owner. The owner reserves the right to refuse admittance if this condition is not observed.
Complaints
If during the course of the holiday the hirer has any reason for complaint he should contact the owner as soon as possible in order that immediate remedial action may be taken.
Arbitration
Disputes arising out of or in connection with this contract which cannot be amicably settled, may, if the hirer so wishes, be referred to the Chartered Institute of Arbitrators.
